Klondike class action alleges website not accessible to blind and visually impaired

Who: Valerie Dicks has filed a class action lawsuit against Unilever United States, Inc.

Why: Dicks claims that parent company Unilever has not designed and maintained its klondikebar.com website to be fully accessible to people who are blind or partially sighted.

According to a new class action lawsuit, Unilever failed to create and maintain a website that is fully accessible to those who are blind or partially sighted.

According to the plaintiff Valerie Dicks, Unilever denies equal access to the products and services available on its klondikebar.com website to those who are blind or partially sighted.

Dicks contends that "severe access restrictions" on klondikebar.com make it "difficult, if not impossible," for blind and visually impaired people to utilize the website or conduct business there.

According to the Klondike class action lawsuit, "Defendant violates basic equal access requirements under state and federal law by not making the Website accessible to those who are blind."


The Klondike Class Action Claims Website is not compatible with screen reader software

Dicks asserts that the screen-reading software she and other blind and visually impaired individuals use to navigate the Internet is incompatible with the Unilever website klondikebar.com.

According to the Klondike class action lawsuit, obstacles to using screen reader software on the Klondike website include, but are not limited to, inaccessible contact information, a keyboard trap, an incorrect landing structure, and a lack of alt text on visuals.

The Klondike class action lawsuit claims that "Klondikebar.com contains access hurdles that restrict free and complete usage by plaintiff and blind people utilizing keyboards and screen-reading software."


Dicks asserts that Unilever has violated the Americans with Disabilities Act, the New York State Civil Rights Law, and the New York City Human Rights Act.

The plaintiff requests a jury trial, declaratory and injunctive relief, as well as an award of compensatory and statutory damages for each individual member of the class and for the entire plaintiff.

Dicks wants to speak for the blind or visually impaired who have been excluded from enjoying the goods and services available on klondikebar.com as well as a national class and a New York underclass.


Unilever also voluntarily recalled two of its Suave 24-Hour Protection spray antiperspirants in March after an internal examination revealed they contained a high concentration of benzene, a known human carcinogen.
